If you were notified that your Private Information was potentially compromised in the November 2023 targeted cyberattack on Alta Resource's computer systems, then you may be a Class Member and eligible for benefits. Excluded from the Settlement Class are: (i) Defendant and Defendant’s parents, subsidiaries, affiliates, officers and directors, and any entity in which Defendant has a controlling interest; (ii) all individuals who make a timely election to be excluded from this proceeding using the correct protocol for opting out; (iii) the attorneys representing the Parties in the Action; (iv) all judges assigned to hear any aspect of the Action, as well as their immediate family members; and (v) any person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the Data Breach, or who pleads nolo contendere to any such charge.
If you are a Class Member and wish to receive Settlement Benefits then you must submit a claim form by August 17, 2026.
All Class Members are eligible for Credit Monitoring and may claim one of two Cash Payment options. The benefits are explained in more detail below.
Credit Data Monitoring. All Class Members are eligible to enroll in two (2) years of Credit Monitoring by a credit bureau. Enrollment codes have been sent to all Class Members, and you will receive activation instructions after the Settlement has received final approval. If you no longer have your enrollment code, please contact the Settlement Administrator. This benefit comes with $1 million in identity theft insurance, and includes:
If anything suspicious happens, you will be able to talk to a fraud resolution agent to help fix any problems.
Expense Reimbursement. If you incurred actual, documented out-of-pocket losses due to the Data Breach, you can get back up to $2,000.00. The losses must have occurred between November 17, 2023, and August 17, 2026, and you cannot claim a payment for expenses that have already been reimbursed by a third party. This benefit covers out-of-pocket expenses like:
losses because of identity theft or fraud
fees for credit reports, credit monitoring, or freezing and unfreezing your credit
cost to replace your IDs
postage to contact banks by mail
You will need to send proof, like bank statements or receipts, to show how much you spent or lost. You can also send notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Data Incident.
Alternate Cash Payment. Instead of Expense Reimbursement, you may claim a one-time cash payment. The payment is expected to be $50.00, but may be larger or smaller depending on the total claims filed. You do not have to provide any proof or explanation to claim this payment.
There is an aggregate cap of $675,000.00 on the Settlement benefits. This means that if the total value of benefits claimed is over $675,000.00, payments will be reduced pro rata so that the total amount of Settlement benefits paid shall not exceed $675,000.00.
